eIDAS

eIDAS (Electronic Identification, Authentication and Trust Services) is an EU regulation (No 910/2014) that establishes a legal framework for electronic signatures, seals, and trust services across all EU member states.

eIDAS defines three tiers of electronic signature: Simple Electronic Signature (SES), Advanced Electronic Signature (AdES), and Qualified Electronic Signature (QES). QES carries the highest legal weight and is equivalent to a handwritten signature under EU law. eIDAS ensures that a signature accepted in one member state must be accepted in all others, enabling seamless cross-border transactions within the EU.

What is the difference between AdES and QES under eIDAS?

AdES requires the signature to be uniquely linked to the signer and capable of identifying them, but does not require a qualified certificate. QES additionally requires a qualified certificate issued by an EU-approved trust service provider and is the only level legally equivalent to a handwritten signature.

Does eIDAS apply outside the EU?

eIDAS is EU law, so it directly governs EU member states. Non-EU countries may recognize eIDAS-compliant signatures through bilateral agreements, but are not legally required to do so.
